AGB’s - Allgemeine Geschäftsbedingungen und Kundeninformation
1. Geltungsbereich
Die nachstehenden Geschäftsbedingungen gelten für alle Verträge, die Sie mit uns als Anbieter (ZZOLU) ) über die Internetseite www.zzolu.art) schließen. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu einem Zwecke abschließt, der überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden kann.
2. Vertragspartner
Der Kaufvertrag kommt zustande mit ZZOLU, Inhaber: Zsa Zsa Gersina, Planufer 78, 10967 Berlin, Deutschland.
3. Vertragsschluss
3.1 Gegenstand des Vertrages ist der Verkauf von Waren.
3.2 Die Darstellung der Produkte im ZZOLU Online-Shop stellt kein rechtlich bindendes Angebot, sondern nur eine Aufforderung zur Bestellung dar.
3.3 Durch Anklicken des Buttons [Kaufen/kostenpflichtig bestellen] geben Sie eine verbindliche Bestellung der auf der Bestellseite aufgelisteten Waren ab. Ihr Kaufvertrag kommt zustande, wenn wir Ihre Bestellung durch eine Auftragsbestätigung per E-Mail unmittelbar nach dem Erhalt Ihrer Bestellung annehmen.
4. Zurückbehaltungsrecht, Eigentumsvorbehalt
4.1 Ein Zurückbehaltungsrecht können Sie nur ausüben, soweit es sich um Forderungen aus demselben Vertragsverhältnis handelt.
4.2 Die Ware bleibt bis zur vollständigen Zahlung des Kaufpreises das Eigentum von ZZOLU.
5. Gewährleistung
5.1 Es bestehen die gesetzlichen Mängelhaftungsrechte.
5.2 Als Verbraucher werden Sie gebeten, die Ware bei Lieferung auf Vollständigkeit, offensichtliche Mängel und Transportschäden zu überprüfen und ZZOLU oder dem Versanddienstleister Beanstandungen schnellstmöglich mitzuteilen. Kommen Sie dem nicht nach, hat dies keine Auswirkung auf Ihre gesetzlichen Gewährleistungsansprüche.
6. Preise und Versandkosten
6.1 Zusätzlich zu den angegebenen Preisen erhebt ZZOLU en für die Lieferung eine Versandkostenpauschale, abhängig vom Empfängerland und – Paketgrösse. Die Versandkosten werden Ihnen im Vorfeld mitgeteilt. Die in den jeweiligen Angeboten angeführten Preise sowie die Versandkosten stellen Gesamtpreise dar. Sie beinhalten alle Preisbestandteile einschließlich aller anfallenden Steuern.
6.2 Erfolgt die Lieferung in Länder außerhalb der Europäischen Union können ggf. weitere Kosten anfallen, wie z.B. Zölle, Steuern oder Geldübermittlungsgebühren (Überweisungs- oder Wechselkursgebühren der Kreditinstitute), die von Ihnen zu tragen sind. Entstandene Kosten der Geldübermittlung sind von Ihnen auch in den Fällen zu tragen, in denen die Lieferung in einen EU-Mitgliedsstaat erfolgt, die Zahlung aber außerhalb der Europäischen Union veranlasst wurde.
7. Individuell angefertigte Produkte/ Kleider
7.1 Die Produkte / Kleider werden individuell für den Kunden hergestellt. (Schnitt / Stoffauswahl / Größe). Ein Rücktrittsrecht nach Bestellung und Auftragsbesstätigung besteht daher nicht.
7.2 Der übliche Produktionszeitraum für individuell hergestellten Produkt beträgt ca. 5-7 Wochen. Davon ausgenommen sind Zeiträume, die in denen die Produktionsstätte betriebsbedingt z.B. Urlaub hat. Die kann in der Folge zu längeren Lieferzeiten führen. ZZOLU informiert den Kunden dazu rechtzeitig
8. Zahlung
8.1 Die Zahlung erfolgt per Vorkasse und nach Auftragsbestätigung. Die Bankverbindung steht in der Auftragsbestätigung. Dir Ware wird erst nach Zahlungseingang geliefert.
9. Eigentumsvorbehalt
Bis zur vollständigen Zahlung bleibt die Ware Eigentum von ZZOLU.
10. Sachmägelgewährleistung
ZZOLU haftet für Sachmängel nach den hierfür geltenden gesetzlichen Vorschriften, insbesondere §§ 434 ff Bürgerliches Gesetzbuch.
11. Rechtswahl, Erfüllungsort, Gerichtsstand
Es gilt deutsches Recht. Bei Verbrauchern gilt diese Rechtswahl nur, soweit hierdurch der durch zwingende Bestimmungen des Rechts des Staates des gewöhnlichen Aufenthaltes des Verbrauchers gewährte Schutz nicht entzogen wird (Günstigkeitsprinzip). Erfüllungsort für alle Leistungen aus den mit ZZOLU bestehenden Geschäftsbeziehungen sowie Gerichtsstand ist unser Sitz, soweit Sie nicht Verbraucher, sondern Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen sind. Dasselbe gilt, wenn Sie keinen allgemeinen Gerichtsstand in Deutschland oder der EU haben oder der Wohnsitz oder gewöhnliche Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt ist.
